DELTA APC: APPEAL COURT RESERVES RULING ON AUTHENTIC STRUCTURE, OTHERS


The Appeal Court sitting in Benin yesterday (07/05/19) reserved it's ruling on the ongoing Cases between APC and Anor vs Chief Cyril Ogodo and four Ors on one side and INEC vs Chief Cyril Ogodo and five Ors on the other hand after hearing the arguments of the Appellants and Defendants in both cases.

It should be recalled that on march 18, 2019 a Federal High Court sitting in Asaba delivered a resounding landmark  judgement that gave the authenticity of the party Structure to Chief Cyril Abeye Ogodo led Executives in Delta APC and also voided all actions taken by the ousted Jones Erue led faction. The judgement further  nullified the candidature of all winners of the primary elections conducted by the Jones Erue led faction that produced Sen.Ovie Omo-agege, Rev. Francis Waive  and other elected members of the Delta state House of Assembly.

Records available at the Appellate Court are showing that the All Progressives Congress, APC and Another approached the appeal Court as separate Appellants from the Independent National Electoral Commission (INEC) who also appealed the march 18, 2019 judgement in favour of the Ogodo led Delta APC respectively.

The Senator representing Delta Central in the 8th National Assembly, Ovie Omo-Agege and Chief Great Ogboru whose cases were earlier dismissed when they appealed to join as affected parties were left with no option than to seek the help of the National Chairman of the All Progressives Congress, HE. Comr Adams Oshiomole to appeal the case.

Our reporter also gathered that the legal Counsel that represented the party and INEC were known personal lawyers of Ovie Omo-Agege who hinged their arguments on the technicalities of the aforementioned judgement stating it was time bound.

The legal Counsels to Chief Cyril Abeye Ogodo gave counter arguments to drive home why the judgement given by the Federal High Court Asaba should be upheld by the Appellate court.

The cases were then adjourned for judgement after adoption by all parties present.
